Bollywood Film Kala Hiran Sparks Real-Life Controversy

MUMBAI, July 27 — A Bollywood film revisiting a wildlife poaching case involving a well-known actor has run into a legal wall, with the Delhi High Court ordering the removal of its promotional material. The dispute offers a reminder of the limits of artistic licence when a living celebrity’s reputation is at stake. The film in question is Kala Hiran: The Battle for Legacy, described by its producers as a work of fiction but understood to be based on the 1998 blackbuck poaching case involving superstar Salman Khan.

The teaser, notably, never names Khan. Yet the Delhi High Court took issue with the inference.

The Court Ruling

Producer Amit Jani’s legal team had argued that the teaser was a creative work and therefore exempt from personality rights claims. The court disagreed. It ordered the removal of social media links promoting the film, holding that even indirect references to a celebrity’s criminal case could be restricted if they appeared to exploit the actor’s notoriety for commercial gain.

The court’s reasoning underscores a core tension in India’s entertainment industry: where does creative storytelling end and commercial exploitation of a public figure’s legal troubles begin? For all the noise about artistic freedom, the court’s logic was that drawing a clear enough picture for audiences to connect the dots is itself a form of misappropriation.

The law cares about effect, not just explicit naming.

Implications for Bollywood

Bollywood has a long history of drawing inspiration from real-life events and scandals. The 1998 blackbuck case remains one of the industry’s most well-known legal sagas. Kala Hiran would have been a major film to dramatise it directly, albeit under a thin veneer of fiction. That veneer, it would seem, was not enough.

The outcome of this case may well influence how Bollywood producers approach biographical or event-based narratives, especially those entangled with ongoing or high-profile legal matters. The risks are now clearer: a film that trades on a living figure’s notoriety, even without naming them, can be blocked or forced to withdraw its marketing.

That is a practical constraint that writers and directors will have to consider. The case also highlights the delicate legal balance Indian courts must maintain. On one hand, the film industry thrives on reinterpreting reality.

On the other, public figures have personality rights that protect them from unauthorised commercial use of their identity, including oblique references to their criminal case. For now, the teaser for Kala Hiran: The Battle for Legacy has been ordered off social media.

The teaser may have been pulled, but the broader question of where the line between art and reputation should sit in Indian cinema is still open. Producers will be watching for any further rulings in this matter, and the next film to test the boundary may not wait long.
